Terms of Service

1. The Service

LuminStage uses artificial intelligence to edit photographs of real property. The Service currently provides virtual staging (adding furniture to images of empty rooms) and day-to-dusk conversion (adjusting the apparent time of day in an exterior image). We may add, change or remove features over time.

2. Accounts

• You must provide accurate information and keep your login credentials secure.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old and capable of forming a binding contract.
• Notify us promptly at support@luminstage.com if you believe your account has been compromised.

3. Credits and subscriptions

• The Service operates on credits. Generating an image consumes credits at the rate shown in the app at the time of use.
• Credits are consumed only when a generation succeeds. Failed generations are not charged.
• A limited number of regenerations of the same source image are included without additional credits, as indicated in the app.
• Paid plans are monthly subscriptions that renew automatically until cancelled.
• When you first subscribe, your plan's credits are added to any credits already in your account.
• On each renewal your balance is reset to your plan's monthly allocation. Unused credits from the previous period do not carry over.
• If your subscription is cancelled, any remaining credits expire and are not refunded.
• A failed payment does not remove your credits. Your balance is kept while we retry, so you can update your card and continue.
• Credits have no cash value and cannot be exchanged, transferred or redeemed for money.

4. Pricing, currency and GST

All prices are shown in Australian Dollars (AUD) and include Australian GST where applicable. Payments are processed by Stripe; we do not receive or store your full card details. We may change pricing on notice, and changes take effect at your next renewal.

5. Your images and content

• You retain ownership of the images you upload.
• You grant us a limited licence to store, process and transmit your images solely to provide the Service to you — including sending them to our AI processing providers.
• You must have the right to upload each image and to have it edited. Do not upload images you do not own or are not authorised to use.
• Do not upload images containing identifiable individuals without their consent, or any unlawful, infringing or offensive material.

6. Ownership of generated images

As between you and us, you own the images the Service generates from your uploads and may use them commercially, including in property listings and marketing material. This is subject to your compliance with these Terms and with the terms of the underlying AI model providers. We may retain generated images in your gallery so you can access them.

7. Real estate advertising — your responsibility

Images produced by the Service are digitally altered marketing visualisations. They do not depict the actual condition, contents or lighting of a property. You are solely responsible for ensuring that any use of generated images complies with the advertising, disclosure and consumer protection laws that apply to you — including Australian Consumer Law and state or territory real estate legislation — and for disclosing that images are digitally staged or enhanced where required.

You must not use the Service to misrepresent a property. Do not use it to conceal defects, alter structural features in a misleading way, or otherwise create a false impression of what is being sold or leased.

8. Acceptable use

• Do not use the Service unlawfully or to infringe anyone's rights.
• Do not resell, sublicense or provide the Service to third parties as your own service without our written agreement.
• Do not attempt to reverse engineer, scrape, overload or circumvent access controls or usage limits of the Service.
• Do not share your account with people outside your organisation.

We may suspend or terminate accounts that breach these Terms.

9. Availability and AI output

The Service is provided on an "as is" and "as available" basis. AI output is inherently variable and we do not warrant that generated images will meet a particular standard, be free of artefacts, or be fit for any specific listing. We do not guarantee uninterrupted availability and may perform maintenance or change third-party providers.

10. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where our liability for a failure to comply with a consumer guarantee can be limited, our liability is limited (at our option) to resupplying the services or paying the cost of having the services resupplied.

11. Limitation of liability

Subject to section 10, and to the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profits, loss of business, or loss arising from your use of generated images. Subject to section 10, our total liability arising out of or in connection with the Service in any 12-month period is limited to the amount you paid us for the Service in the 12 months before the claim arose.

12. Indemnity

You indemnify us against claims, losses and costs arising from your breach of these Terms, your uploaded content, or your use or publication of generated images — including claims that a listing using generated images was misleading.

13. Termination

You may stop using the Service at any time and cancel your subscription as described in the Refunds & Cancellation Policy. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service and any unused credits end.

14. Changes to these Terms

We may update these Terms. If a change is material, we will take reasonable steps to notify you — for example by email or a notice in the app — before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State.
